Bhorkit Policies

These policies explain how Bhorkit sells, delivers and supports its products, and what we each need to do to make an order go smoothly. Please read them before placing an order. By placing an order on bhorkit.com you agree to the policies set out below.

In these policies, "Bhorkit", "we", "us" and "our" mean [Bhorkit Legal Entity Name], and "you" and "your" mean the person placing an order or using the website.

Nothing in these policies takes away any right you have under applicable law that cannot be taken away by agreement. Where a policy below conflicts with such a right, that right applies.

Shipping & Delivery Policy

1.1Where we deliver

Bhorkit is a local business. We deliver only to the pincodes we have chosen to service, which are currently selected areas of Patna, Bihar. We do not deliver everywhere in India, and we do not ship internationally.

The list of serviceable pincodes is maintained by Bhorkit and can change at any time as we add or withdraw areas. The list shown on our website at the time you place your order is the list that applies to that order.

You can check whether we deliver to your area by entering your pincode on a product page or while adding your delivery address. If your pincode is not covered, you will see a message telling you so, and you will not be able to complete checkout for that address.

1.2Your address is your responsibility

When you place an order, you are telling us where to deliver it. Please make sure the address you enter is complete, accurate and reachable, including:

  • the recipient's full name;
  • house / flat / building number and floor;
  • street, area or locality;
  • a useful landmark, where one helps;
  • the correct city, state and pincode;
  • a working mobile number on which the recipient can be reached at the time of delivery.

We deliver to the address exactly as you have entered it. We do not verify, correct or guess your address, and we cannot confirm that an address exists before we attempt delivery.

1.3A serviceable pincode does not mean the address is correct

This is the most common cause of failed deliveries, so please read it carefully.

Our pincode check confirms one thing only: that Bhorkit currently delivers to that pincode. It does not confirm that the rest of your address is correct, complete or reachable.

It is entirely possible to enter a pincode we serve and still enter a house number, building, street or locality that is wrong, incomplete or does not exist. In that situation the order will be accepted and dispatched, and delivery may still fail.

Where delivery fails because of the address information you provided, that is not treated as a Bhorkit fault, and it does not entitle you to cancellation, a refund or a free re-delivery. Please see the Returns & Refunds Policy and the Cancellation Policy below.

1.4Delivery dates and time slots

Where our website lets you choose a delivery date and a time slot, that choice is a scheduling preference. We plan our deliveries around it and we make reasonable efforts to deliver within the window you selected.

It is not a guarantee. Traffic, weather, festival-season volumes, courier availability, local conditions and other factors outside our control can move a delivery earlier or later. We do not offer compensation for a delivery that arrives outside the selected window.

1.5Delivery attempts

Our delivery partner will attempt to deliver to the address you provided. Someone should be available at the address to receive the order during the selected window.

  • If nobody is available, the delivery partner may attempt to contact the mobile number on the order.
  • Depending on the situation, a further attempt may be made, or the order may be returned to us. We do not guarantee a fixed number of re-attempts.
  • If the recipient refuses to accept the order, it will be treated as a completed delivery attempt.

Repeated failed attempts caused by the recipient being unavailable, the address being unreachable, or the mobile number being switched off or incorrect are treated as customer-side failures, and do not entitle you to a refund.

1.6Incorrect, incomplete or undeliverable addresses

If an order cannot be delivered because the address is wrong, incomplete, unclear, inaccessible or does not exist:

  • the order is treated as fulfilled to the extent we were able to fulfil it;
  • you are not entitled to cancellation, a refund, a replacement or a free re-delivery on that basis;
  • where the products are still in a saleable and safe condition and it is practical for us to do so, we may — entirely at our discretion — offer a re-delivery to a corrected address within a serviceable pincode. Any such re-delivery may be chargeable, and we are not obliged to offer it.

Many of our kits contain fresh and perishable items such as flowers, leaves, fruit and prepared samagri. Once these have travelled and been returned undelivered, they usually cannot be re-sent.

1.7Circumstances outside our control

We are not responsible for delays or failures in delivery caused by events beyond our reasonable control. These can include natural events and severe weather, floods, strikes, civil unrest, accidents, road closures, restrictions imposed by any authority, public health measures, festival crowd restrictions, power or internet failures, and failures of our courier or payment partners.

Where such an event affects your order, we will make reasonable efforts to inform you and to deliver as soon as we reasonably can. If the order genuinely cannot be fulfilled at all, section 1.8 applies.

1.8If Bhorkit cannot fulfil an order we have accepted

Sometimes the fault is ours. If we have accepted and been paid for an order and we then find that we cannot fulfil it — for example the items are genuinely unavailable, we have withdrawn your pincode from our delivery area, or we simply cannot deliver it — then:

  1. we will cancel the order and let you know, using the email address on the order;
  2. we will refund the amount actually received for the part of the order we cannot fulfil;
  3. the refund is made to the original payment method through our payment gateway, and reaches you according to your bank or card issuer's own timelines, which are outside our control.

This is the situation in which a refund does apply. It is different from a customer changing their mind or entering the wrong address, and it should not be confused with those.

1.9What we ask of you

To help your order arrive:

  • check the product, quantity, address and pincode carefully before you pay;
  • give a mobile number that will be reachable at the time of delivery;
  • make sure someone can receive the order at the address during the window you selected;
  • tell us promptly if you notice a mistake in your order, so we can see whether anything can still be done before dispatch. We cannot promise that a change will be possible.

1.10Delivery support

For anything to do with a delivery, write to us at bhorkit@gmail.com with your order number. Including the order number lets us find your order quickly.

Returns & Refunds Policy

2.1Our general position

Bhorkit sells devotional and festival products, including kits containing fresh flowers, leaves, fruit, ghee, prepared samagri and other consumable items. These are made up and packed for your order, and they are used in personal worship.

For reasons of hygiene, safety and the nature of the goods, we do not accept returns and we do not provide refunds on completed, paid orders, except in the specific situations set out in this policy or where a refund is required by applicable law.

2.2Change of mind

We cannot accept a return or give a refund because you changed your mind, ordered the wrong item, ordered the wrong quantity, no longer need the product, or found it elsewhere. Please check your order carefully before paying.

2.3Incorrect address, and the pincode question

A refund is not available where delivery failed or was delayed because of the address information you gave us. This includes an address that is wrong, incomplete, unclear, unreachable or non-existent, and a recipient mobile number that is wrong or unreachable.

This applies even when the pincode you entered was one we serve. Our pincode check confirms only that we deliver to that pincode. It does not confirm the house number, building, street or locality. Entering a serviceable pincode alongside an incorrect address does not make a failed delivery our responsibility, and does not create a right to cancellation or refund.

2.4Damaged, wrong or missing items

If your order arrives damaged, if you receive a product other than the one you ordered, or if something listed on your invoice is missing, please tell us so we can look into it.

How to report it

  • Write to bhorkit@gmail.com within 1 Day of delivery.
  • Include your order number.
  • Include clear photographs showing the problem — the outer packaging, the sealed or opened kit, and the affected items. For a missing item, a photograph of everything you did receive, laid out, helps us the most.
  • Please keep the packaging and the items until we have finished looking into it.

What happens next

We will review what you send us and respond. Where we are satisfied that the item was damaged in transit, wrongly supplied or missing when it left us, we will offer a suitable resolution. Depending on what is available and practical at the time, that may be a replacement of the affected item, or a refund of the amount paid for it.

We decide which resolution to offer, and we may decline a claim we cannot verify, or one reported after the window above. Minor variation in the colour, size, packaging or appearance of natural items such as flowers, leaves, clay and fruit is normal and is not a defect.

2.5Payment failed, and payment succeeded

These are different situations, and it helps to keep them apart.

  • Payment did not go through. No order is created and we receive nothing. If an amount was debited from your account for a failed payment, it is normally reversed automatically by your bank or card issuer within their own timelines. That reversal is between you, your bank and the payment gateway; Bhorkit does not hold that money.
  • Payment went through. The order is confirmed and this Returns & Refunds Policy applies to it.

If money has left your account but you did not receive an order confirmation, write to bhorkit@gmail.com with the date, amount and payment reference, and we will check our records.

2.6Duplicate payments

If you were genuinely charged more than once for the same order — for example, a network problem caused you to submit payment twice — tell us at bhorkit@gmail.com with the payment references. Once we and our payment gateway have confirmed the duplicate, we will refund the extra amount to the original payment method.

2.7Where Bhorkit cannot fulfil a paid order

If we accept and are paid for an order and then cannot fulfil it, we will cancel it and refund the amount received for the part we cannot fulfil, as described in section 1.8. This is a Bhorkit-side cancellation, and it is the main circumstance in which a refund arises.

2.8Your legal rights

Nothing in this policy removes or limits any right you have under applicable Indian law that cannot be excluded by agreement — including rights relating to goods that are defective, unsafe or not as described. Where applicable law requires a remedy, that requirement applies regardless of anything stated above.

2.9How refunds are processed

Where a refund does apply under this policy or under applicable law:

  • it is made to the original payment method used for the order. We do not refund to a different account, in cash, or as store credit unless we specifically agree otherwise;
  • we initiate it through our payment gateway once the refund has been approved;
  • the time it takes to appear in your account is set by your bank, card issuer or payment provider, and is outside our control. We are not able to guarantee a date;
  • we refund the amount actually received by us. Any charges levied by your own bank or payment provider are not within our control.

Privacy Policy

This policy explains what personal information Bhorkit collects when you use bhorkit.com, why we collect it, and what we do with it.

3.1What we collect

Information you give us

  • Your name and email address, and the profile picture associated with your account, when you sign in using Google.
  • Delivery address details: recipient name, mobile number, house/flat details, area, landmark, city, state and pincode.
  • Order information: the products you order, quantities, amounts, delivery date and time slot, and any notes you add.
  • Your email address if you ask to be notified when a collection becomes available.
  • Anything you send us when you contact support.

Information created when you use the site

  • Your order and payment history with us, including invoice records.
  • Basic technical information that any website receives, such as your device and browser type and the pages you visit, which is used to operate and secure the site.

Payment information

Payments are processed by our payment gateway. Bhorkit does not collect or store your card number, CVV, UPI PIN, netbanking credentials or similar payment credentials. We receive only a payment reference and confirmation of whether the payment succeeded, along with the payment method type used.

3.2How we use your information

We use your information to:

  • create and manage your account;
  • process, pack and deliver your orders, including sharing what the delivery partner needs;
  • take payment and confirm it, and to issue your invoice;
  • send you transactional emails — order confirmation, invoice, payment failure notices and account emails. These relate to your order or account and are not marketing;
  • send you a launch notification if, and only if, you asked to be notified about a collection;
  • answer your support queries;
  • keep proper business, accounting and tax records;
  • detect, prevent and investigate fraud, abuse and security problems.

We do not sell your personal information.

3.3Who we share it with

We share your information only where it is needed to run the service:

  • Payment gateway — to take payment and to process any refund. Your payment credentials go directly to them, not to us.
  • Email service provider — to send order, invoice and account emails on our behalf.
  • Google — where you choose to sign in with Google, sign-in is handled by Google under Google's own privacy policy.
  • Delivery personnel — the recipient name, address and mobile number needed to deliver.
  • Hosting and database providers — who store the data that runs the site.

We may also disclose information where we are required to do so by law, by a court, or by a government authority, or where it is necessary to protect our rights, our customers or the public.

3.4Cookies and similar technologies

We use a small number of strictly necessary items:

  • a secure sign-in cookie, which keeps you logged in and is required for your account, cart and checkout to work;
  • browser storage on your own device, used to remember things like a cart created before you signed in, your recently viewed products and whether a promotional message has already been shown to you.

At the time of writing, Bhorkit does not use third-party advertising cookies, and does not run third-party analytics or tracking pixels on the website. If that changes, this policy will be updated first.

You can clear or block cookies and site data in your browser settings. If you block the sign-in cookie, you will not be able to sign in, place an order or use the cart.

3.5How we protect your information

We take reasonable technical and organisational measures to protect your information. These include transmitting data over encrypted connections, restricting who can access customer data, keeping payment credentials out of our systems entirely, and protecting the sign-in session so it cannot be read by scripts in your browser.

No website or method of transmission is completely secure, and we cannot guarantee absolute security. Please keep access to your email account secure, since it is what signs you in.

3.6How long we keep it

  • Order, invoice and payment records are kept for as long as we need them for accounting, tax and legal purposes.
  • Account and address information is kept while your account is active.
  • Launch notification subscriptions are kept until you unsubscribe or ask us to remove you.
  • Support correspondence is kept for as long as we need it to resolve and evidence the query.

Where information is no longer needed, we delete it or stop using it in a form that identifies you.

3.7Your choices and requests

Depending on the rights available to you under applicable law, you may ask us to:

  • give you a copy of the personal information we hold about you;
  • correct information that is wrong or out of date;
  • delete information we no longer need to keep;
  • stop sending you launch notifications.

You can unsubscribe from launch notification emails using the unsubscribe link in the email itself. For anything else, write to bhorkit@gmail.com from the email address on your account, so we can be reasonably sure the request is genuinely yours.

We will respond within a reasonable period. We may need to keep certain records — such as invoices and payment records — even after a deletion request, where the law requires us to.

This policy is intended to be consistent with applicable Indian law on personal data. We do not claim certification under, or formal compliance with, any particular standard or foreign privacy regulation.

3.8Children

The website is intended for use by adults. We do not knowingly collect personal information from children. If you believe a child has given us personal information, write to us and we will remove it.

Terms & Conditions

4.1About these terms

These terms apply to your use of bhorkit.com and to every order you place with us. Please read them together with the Shipping & Delivery, Returns & Refunds, Cancellation and Privacy policies in this document, which form part of these terms.

If you do not agree with these terms, please do not use the website or place an order.

4.2Using the website

You may use the website to browse our products and to place orders for your own use. You agree to give accurate information, and not to use the website in a way that is unlawful, or that interferes with its operation or with other customers' use of it.

4.3Your account

You can create an account by signing in with Google. You are responsible for keeping access to that email account secure, and for activity carried out through your Bhorkit account.

Tell us promptly at bhorkit@gmail.com if you believe someone else has used your account. We may suspend or close an account where we reasonably believe it is being used for fraud or abuse, or in breach of these terms.

4.4Products, descriptions and images

We describe our products as accurately as we can. Photographs, styling props and packaging shots are for illustration. Natural items such as flowers, leaves, fruit and clay vary in colour, size and appearance, and what you receive may differ slightly from an image. Kit contents may change where an item is unavailable, and we may substitute an item of similar type and value.

4.5Prices

Prices are shown in Indian Rupees. Any discounts, handling charges or other amounts are shown at checkout before you pay. The total shown at the time you pay is the amount payable for that order.

We may change prices at any time. A change does not affect an order that has already been paid for.

4.6Availability

All products are subject to availability. Listing a product on the website is not a promise that it is in stock or that we can supply it.

4.7Orders and acceptance

Placing an order is an offer to buy. A contract is formed only when we accept your order, which happens when we confirm it after successful payment.

We may decline or cancel an order before or after acceptance where, for example, the product is unavailable, the delivery address is outside our serviceable pincodes, we suspect fraud or abuse, there has been an error in the price or product information, or we are otherwise unable to fulfil it. Where we cancel a paid order, section 1.8 applies.

4.8Payment

Payment is collected online at the time of ordering, through our payment gateway (Razorpay). We do not offer cash on delivery. An order is confirmed only when payment succeeds. Your payment credentials are handled by the gateway and are not stored by Bhorkit.

4.9Delivery, pincodes and your address

We deliver only within our serviceable pincodes, as set out in section 1.1. You are responsible for the accuracy and completeness of the delivery address and the recipient's mobile number, as set out in sections 1.2 and 1.3.

A serviceable pincode does not confirm that the rest of the address is correct. Where delivery fails because of the address information you provided, you are not entitled to cancellation or a refund.

4.10Cancellation, returns and refunds

Once an order has been successfully placed and paid for, you cannot cancel it. We do not accept returns and do not refund completed, paid orders, except as set out in the Returns & Refunds Policy and the Cancellation Policy above, or where applicable law requires it.

4.11Errors

Despite our care, the website may occasionally contain an error in a price, description, image or availability. Where we identify an obvious error affecting an order, we may cancel that order and refund the amount received. We will tell you if we do.

4.12Intellectual property

The Bhorkit name and logo, the website design, text, photographs, graphics and product content are owned by Bhorkit or licensed to us, and are protected by law. You may not copy, reproduce, distribute or use them commercially without our written permission.

4.13Things you must not do

You agree not to:

  • place orders fraudulently, or using someone else's payment details or identity;
  • attempt to gain unauthorised access to the website, other customers' accounts, or our systems;
  • copy, scrape or systematically extract content or data from the website;
  • interfere with the operation of the website, or introduce anything harmful to it;
  • resell our products as your own without our written permission;
  • misuse our support channels or delivery personnel, including abusive behaviour.

4.14Limitation of liability

We take responsibility for supplying the products you ordered, in line with these policies and with applicable law.

To the extent permitted by law, Bhorkit is not liable for indirect or consequential loss, for loss of profit or opportunity, or for loss arising from an event outside our reasonable control, from inaccurate address information you provided, or from your misuse of a product. Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.

Where our liability for an order is limited by law to a maximum amount, and to the extent permitted, our total liability in connection with an order will not exceed the amount you paid for that order.

4.15Circumstances outside our control

Neither party is responsible for a failure or delay in meeting its obligations caused by an event outside its reasonable control, as described in section 1.7.

4.16Changes

We may update these terms and the policies in this document. The version published on the website at the time you place an order applies to that order. Please check the "Last Updated" date below.

4.17Governing law and jurisdiction

These terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the courts at [Jurisdiction City], [State], India.

Cancellation Policy

5.1Orders cannot be cancelled once placed

Once your order has been successfully placed and paid for, it cannot be cancelled by you.

We begin preparing orders shortly after they are confirmed. Our kits are assembled for each order and contain fresh and perishable items, so an order that has been confirmed cannot be unwound.

This applies whether you ask to cancel a few minutes after ordering or later, and whether or not the order has been dispatched.

5.2Please check before you pay

Because you cannot cancel afterwards, please take a moment before paying to confirm:

  • the products in your order are the ones you want;
  • the quantity of each item is correct;
  • the delivery address is complete and correct — recipient name, house or flat number, building, street, area, landmark, city and state;
  • the pincode is correct and is one we serve;
  • the mobile number is one the recipient will answer at the time of delivery;
  • the delivery date and time slot suit you.

Everything you need to check is shown on the checkout page before payment.

5.3A wrong address is not a cancellation reason

Entering an incorrect, incomplete or undeliverable address is not a reason for cancellation or refund, and this remains the case where the pincode you entered was one we serve.

Our pincode check confirms only that we deliver to that pincode. It cannot tell whether your house number, building, street or locality is right. If those are wrong, the order will still be accepted and prepared, and any resulting failed delivery is a customer-side failure. Sections 1.3, 1.6 and 2.3 explain this in full.

If you spot a mistake in your address, tell us at bhorkit@gmail.com immediately with your order number. If the order has not yet been packed, we will see whether a correction is possible as a goodwill measure. We cannot promise that it will be, and it does not create a right to cancel or to a refund.

5.4Two different things called "cancellation"

It helps to keep these apart:

5.5Cancellation by Bhorkit

We may cancel an order, before or after accepting it, where:

  • an item is genuinely unavailable and cannot be supplied;
  • the delivery address falls outside our serviceable pincodes, including where we have withdrawn that pincode;
  • there has been an obvious error in the price or the product information;
  • we reasonably suspect fraud, abuse or a breach of our terms;
  • an event outside our reasonable control prevents us from fulfilling the order;
  • we are otherwise unable to fulfil it.

Where we cancel a paid order for any of these reasons, we will tell you by email at the address on the order, and we will refund the amount received for the part we cannot fulfil, to the original payment method, as described in sections 1.8 and 2.9. How quickly it reaches your account depends on your bank or card issuer.

5.6Unpaid and abandoned checkouts

If you begin checkout but do not complete payment, no order is created and there is nothing to cancel. Any amount debited for a failed payment is normally reversed automatically by your bank — see section 2.5.

5.7Your legal rights

Nothing in this policy removes any right you have under applicable law that cannot be excluded by agreement, including rights relating to goods that are defective, unsafe or not as described.
